as secretary of defense and as c.i.a. director for the last several years. the majority leader knows full well that the reason why cloture was denied or the debate -- closing off debate was denied is because there are reasonable requests being made on this side for additional information, and i hope and trust that that information will be provided here in the next few days and when we come back from the recess, we'll have another vote and another opportunity for senators to express themselves. but this is not any attempt to kill this nomination. this is not a filibuster. i realize that's the headline that the majority leader would like the newspapers to write. we actually had some very reasonable discussions going on earlier today among senators on the democratic side and republican side to try to work this out. given the fact that this nomination has just so recently been reported from the armed services committee and o to accommodate the reasonable requests from senators to get answers to their legitimate questions. and we didn't need to have this vote today. we could have -- we could have d

nomination go forward, that no cia or the department of defense cannot kill someone in america without you know, any kind of judicial proceeding. senator widen asked this, can you kill an american on american soil with a drone without a judicial hearing and brennan didn't answer the question. so, we've asked it in writing. my understanding is senator wyden has answered in writing. so if you're not going to answer no, i think that means you're telling us yes, you believe that the president has the power to kill an american in america. that is appalling. i think even overseas that if there is someone who's not in the middle of firing a gun or grenade launcher, that they really should be tried for treason if they're an american citizen, then you can proceed on with drone attacks, but really an american citizen should be tried in court here or abroad unless they're imminently in the act of firing a weapon. >> and when it comes to hagel's nomination, obviously john mccain indicating he may filibuster it. tom rex is a contributing editor for foreign policy magazine. a lot of sources in the penta

as cia director as it waits for more information on the drone program he has orchestrated. on wednesday, a committee chaired i am feinstein reiterated a demand to see all nine classified justice or memos on the supposed legal basis for targeted killings of u.s. citizens. two memos were released in the committee last week. lawmakers have also floated the idea of creating a special court to review strikes on u.s. citizens. south african nobel peace prize winner archbishop desmond tutu weighed in on the plan in a letter to the new york times writing -- meanwhile in new york, nine people were arrested wednesday after blocking the gate of a base where drones are operated remotely. the protesters held signs condemning the killings of children and other civilians as they stood in front of the entrance to hancock field air national guard base near syracuse in upstate new york. the european union and u.s. have confirmed plans to begin negotiating what could be the biggest ever free-trade deal of its kind. president obama noted the potential agreement in his state of the union speech on tuesday.

remember all that? involving the former head of the cia general petraeus? national security correspondent jennifer griffin is live at the pentagon. what is the latest you're hearing about general allen and this decision, jennifer? >> reporter: well, remember, jon, general john allen was supposed to leave as the top commander in afghanistan and got to become the supreme allied commander in europe but that's when the jill kelley e-mails interfered with that. there was a pentagon inspector general investigation into those e-mails. eventually he was cleared by that investigation. so it looked like his nomination was going to go forward but our white house correspondent, ed henry, heard from sources yesterday that in fact general allen was being pushed out. that he was in fact not going to be renominated as the supreme allied commander in europe and go to nato headquarters. that he in fact would be retiring. the defense department is pushing back on that characterization suggesting that leon panetta, the defense secretary, met with general allen just days ago. here is what panetta said yesterd

-mails that came to light during the resignation of cia director david petraeus. allen exchanged e-mails with tampa socialite joe kelly, and even though a subsequent review cleared allen of any inappropriate activity, yesterday defense secretary leon panetta said allen has been under a tremendous amount of pressure and urged the general to take some time on whether decides whether to take or leave the nato post. >>> turning to the markets and a corporate marriage on valentine's day, american airlines and us airways have formally announced plans to merge, creating the world's largest air carrier. that happens about every three years, doesn't it? this new airline will keep the american name and its ceo. it will offer 6,700 daily flights to nearly 60 countries. it's not the only big deal on wall street today. berkshire hathaway and 3g capital have agreed to buy heinz, a deal valued at more than $23 billion. the news sent the kech yaup maker's stock up more than 20%. should make for an interesting new closure report the next time we look at the john kerry and teresa heinz kerry scloefr reports. up next

be the choice to lead the cia. he would be much more directly involved in the benghazi matter, but this is a way to try to pressure the administration to provide information that congress believes it has a right to have. now, the white house could certainly argue that what the president was doing or what time he went to bed, those sorts of questions, are sort of under an executive privilege. they don't have to tell them about that. it does have a political question. how engaged was the president once he was notified at 5:00 p.m. by secretary panetta that there was an unfolding assault happening in benghazi. those are things that came out through recent testimony through panetta, and the joint chiefs chair that had he had not spoken to the president again after initially informing hem. that created a new sort of political oxygen for republicans who want to know if there was a missing ambassador, what was the president doing, and, of course, the white house says that he was being properly informed by his national security team and so forth, but there are questions they want to know. crediting the
